TERMS OF USE

Future Skills Framework (FSF) for the Malaysian Financial Sector

  1. General and Acceptance of Terms
    1. These Terms of Use (“Terms”) govern your access and/or use of the Future Skills Framework (“FSF”) on our website.
    2. In these Terms, the following references apply:
      1. “We”, “Our” and “Us” refer to Asian Institute of Chartered Bankers (AICB) (Company No. 197701004872 (35880P)); and
      2. “You” and “Your” refer to any person viewing, accessing or using the FSF on our website.
  2. Acceptance of Terms
    1. By clicking “Agree”, or by accessing, viewing, or otherwise using the FSF on our website, you acknowledge that:
      1. you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the FSF on our website; and
      2. you consent to the processing of your personal data for the purposes set out in our Personal Data Protection Notice, which may be found at https://www.aicb.org.my/pdpa (“PDPA Notice”). For the avoidance of doubt, the PDPA Notice shall continue to apply to your use of and access to the FSF.
  3. Intellectual Property
    1. The FSF is the exclusive intellectual property of Asian Institute of Chartered Bankers (AICB) (Company No. 197701004872 (35880P)), Asian Institute of Insurance (Aii) (Company No. 197701004772 (35445H)) and Islamic Banking and Finance Institute Malaysia (IBFIM) (Company No. 200701005076 (763075W)).
    2. All rights, title and interest in and to the FSF, including any associated content and derivative works, are reserved by AICB, Aii and IBFIM.
  4. Permitted and Prohibited Uses
    1. Subject to Section 4(b) below, you understand and agree that you may use, access and/or view the FSF online via our website solely for non-commercial purposes, including:
      1. internal reference within an organisation for the development of learning or capability-building programmes, training materials and educational content, provided that the use remains non-commercial in nature;
      2. educational, research, or informational purposes; and
      3. personal use for individual professional development and learning.
    2. The permitted uses in Section 4(a) above are subject to the following:
      1. Such use must include clear attribution to AICB, Aii and IBFIM, and the FSF as the source, in the following format or a similar format: “Based on the Future Skills Framework developed and owned by AICB, Aii and IBFIM.” For the avoidance of doubt, attribution alone does not confer any form of approval or recognition by AICB, Aii and IBFIM.
      2. Such use shall not include, and must not give rise to, any statement, implication, or inference that the relevant use, initiative, programme, material, or output is endorsed, certified, approved, validated, recognised, or supported by AICB, Aii and IBFIM.
      3. You shall maintain the integrity and accuracy of the FSF content and shall not alter, distort or misrepresent it.
      4. You shall not use the FSF in a manner that may damage, dilute, or otherwise negatively affect the brand and reputation of the FSF, AICB, Aii or IBFIM.
    3. Unless prior written approval is obtained, you shall not, whether directly or indirectly:
      1. use the FSF for any commercial purpose, including selling, licensing, or monetising FSF-based content, products, programmes or services; or incorporating the FSF into paid products, platforms, tools, or services. This includes, without limitation, training programmes, programme recognition or certifications, assessments, or qualifications marketed or represented as FSF-based or FSF-aligned; or software platforms, digital tools, or skills assessment systems derived from the FSF;
      2. download, save, copy, reproduce, extract, communicate, transmit, or otherwise deal with the FSF, in whole or in part, for redistribution;
      3. adapt, modify, translate, rebrand, or create derivative works from the FSF;
      4. display or use the “Future Skills Framework” and/or “FSF” name, trademark or logo in a manner that suggests affiliation, approval, endorsement or certification by AICB, Aii and IBFIM;
      5. represent, whether expressly or impliedly, that any programme, product, or service is affiliated with, approved under, endorsed or certified by the FSF and/or AICB, Aii and IBFIM;
      6. engage in any act that may damage the reputation or integrity of the FSF and/or AICB, Aii and IBFIM; and
      7. use the FSF for any unlawful, illegal or harmful purpose.
    4. If you require a downloadable copy of the FSF, or intend to use the FSF for any commercial purpose, you may submit a request for prior written approval to the FSF Secretariat at fsf@aicb.org.my. All such requests shall be considered on a case-by-case basis, and any approval granted shall be subject to any formal arrangements and conditions that we may impose.
    5. You shall not attempt to bypass, disable, interfere with, or otherwise circumvent any technical, security, or access-control measures, or use any automated means, including bots, scripts, scraping tools, or data-mining technologies, to access, scrape or extract the FSF or its content.
  5. Changes and Modifications
    1. We reserve the right to modify, update or amend these Terms at any time by posting an updated version on our website. Your continued access to or use of the FSF after any changes have been published will constitute acceptance of those modifications, updates or amendments.
    2. We reserve the right to modify, update, amend, discontinue, terminate or restrict access to the FSF at any time, without notice and for any reason.
  6. External Links
    1. The FSF may contain links to resources and materials on third-party websites (“External Sites”). These links are provided for reference and convenience only. Your access to or use of External Sites is at your own risk and is subject to the terms and conditions of those External Sites.
    2. AICB, Aii and IBFIM:
      1. do not endorse, control, or assume responsibility for the content on any External Sites;
      2. make no representations or warranties regarding the accuracy, completeness, or reliability of the content on External Sites; and
      3. disclaim all liability for any loss or damage arising from your use of or reliance on External Sites.
    1. Any third party that creates a hyperlink to the FSF on our website:
      1. is deemed to have accepted and agreed to be bound by these Terms of Use;
      2. does so at its own risk and responsibility; and
      3. must not link in a manner that suggests endorsement, sponsorship, or affiliation with AICB, Aii and IBFIM without permission.
    2. If you have accessed and are viewing the FSF on our website via a hyperlink from an External Site, your continued access to and use of the FSF on our website is also deemed to constitute acceptance of and agreement to be bound by these Terms of Use. If you do not agree, you should immediately cease further access to and use of the FSF on our website.
    3. We reserve the right to:
      1. object to or disable any links to the FSF at our sole discretion;
      2. require the removal of links that are inconsistent with or do not comply with these Terms; and
      3. change, amend, or remove URLs to the FSF on our website at any time without prior notice or liability.
  7. Termination

    We may restrict, suspend, or discontinue your access to the FSF immediately, without prior notice, for any reason, including if you have breached these Terms.

  8. Disclaimer and Limitation of Liability
    1. The FSF is provided on an “as is” basis.
    2. To the fullest extent permitted by law, we exclude all warranties and representations, whether express or implied, in relation to the FSF, its content and information, and its use, access, availability, continuity or non-interruption. This includes, without limitation, any implied warranty of accuracy, fitness for use, fitness for a particular purpose, or non-infringement of third-party rights.
    3. To the fullest extent permitted by law, we shall not be liable to you for any loss or damage of any kind whatsoever, whether foreseeable or not, whether arising in contract, tort, including negligence, breach of statutory duty, or otherwise, arising from or in connection with your access to or use of, or inability to access or use, the FSF and its content or information. This includes, without limitation, any loss of profits, revenue, sales, or business; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss or damage.
  9. Indemnity

    To the fullest extent permitted by law, you hereby agree to indemnify us, our affiliates, agents and/or service providers, and to keep us, our affiliates, agents and/or service providers harmless from any losses, damages, costs, charges, expenses, liabilities, claims or proceedings which we, or any of our affiliates, agents and/or service providers, may suffer as a result of or in relation to your access to or use of the FSF.

  10. Waiver

    No failure or delay on our part in exercising or enforcing any rights or remedies under these Terms will be deemed a waiver of those rights or remedies.

  11. Severability

    Each provision of these Terms shall be deemed severable, and the invalidity or unenforceability of any provision shall not affect the validity or enforceability of the other provisions to the extent permitted by law. We may replace any invalid or unenforceable provision with a suitable and equitable provision to fulfil, so far as may be valid and enforceable, the intent and purpose of the invalid or unenforceable provision.

  12. Governing Law and Jurisdiction

    These Terms are governed by the laws of Malaysia, and you agree to submit to the exclusive jurisdiction of the courts of Malaysia.

  14. Entire Agreement

    These Terms constitute the entire agreement between you and us regarding your use of and access to the FSF, and supersede all prior agreements, representations and understandings, whether written or oral.
